We need your input regarding the class grievance seeking Temporary Hazard Pay (THP) for County of Maui employees in HGEA bargaining units 2, 3, 4, 13, and 15.
An arbitration hearing took place in October 2021 and the arbitrator recently provided a favorable ruling for HGEA, citing that the COVID-19 pandemic has created a hazard for our bargaining unit members. Most bargaining unit members may be entitled to a 15% THP award to their salary from March 4, 2020, until the end of the emergency proclamation.
Now, we are seeking details about your working conditions between March 4, 2020 and March 25, 2022. We need this information to help determine which employees could be eligible for “Most Severe” THP.
Here are the THP definitions according to our contract language:
1. Severe – fifteen percent (15%)
a. Frequent injuries likely but serious accidents rare.
b. Exposure leads to possible eye injurie, loss of fingers, or serious burns.
c. Might Cause incapacitation.
d. Moderate periods of compensable lost time result.
2. Most Severe – twenty-five percent (25%)
a. Exposure likely to result in serious incapacitation, long period of time lost, or possible loss of life.
b. Accidents occur frequently in spite of reasonable safety precautions.
c. Frequent exposure to hazard where failure to exercise extreme care and judgment might cause an accident which would result in total disability of fatality.
