Unit 15 Arbitration Award

Dear Unit 15 Members,

The HGEA Unit 15 (Ocean Safety and Water Safety Officers) arbitration award has now been rendered by the arbitration panel. Arbitration awards are final and binding on the parties, however the respective County Councils must pass funding legislation for cost items. The HGEA will be pushing forward to have the funding bills passed.

Arbitration Decision/Award Summary

Duration

Four (4) year contract period (July 1, 2021 through June 30, 2025)

Effective July 1, 2021

Employees shall receive full credit for service toward step movements.
Continuation of step movements for eligible employees during the period from July 1, 2021 through June 30, 2022. Employees who become eligible for step movements from July 1, 2021 through June 30, 2022 shall receive their step movements on their step movement dates.
All employees who were in the bargaining unit on June 30, 2021 and July 1, 2021, including those employees not administratively assigned to the salary schedule, shall receive a one-time lump sum payment of one percent (1%) based on their June 30, 2021 annual base salary.

Effective July 1, 2022

All employees, including those employees not administratively assigned to the salary schedule, shall receive an increase of three percent (3%).
Continuation of step movements for eligible employees during the period from July 1, 2022 to June 30, 2023. Employees who become eligible for step movements from July 1, 2022 through June 30, 2023 shall receive their step movements on their step movement dates.

Effective July 1, 2023

All employees, including those employees not administratively assigned to the salary schedule, shall receive an increase of four percent (4%).
Continuation of step movements for eligible employees during the period from July 1, 2023 to June 30, 2024. Employees who become eligible for step movements from July 1, 2023 through June 30, 2024 shall receive their step movements on their step movement dates.

Effective July 1, 2024

All employees, including those employees not administratively assigned to the salary schedule, shall receive an increase of four percent (4%).

TA Reached for Unit 15 on EUTF: Voting Starts TODAY

Tentative Agreement on EUTF Reached for Unit 15:

Electronic Ratification Voting Starts Today

Dear Unit 15 Employees,

Your Unit 15 Negotiating Team has reached a tentative agreement (TA) on the Employer-Union Health Benefits Trust Fund (EUTF) with the employer effective August 1, 2022. HGEA has requested release time from the employer to allow you work time to review the TA information and vote.

Below is the Summary of the TA as well as the rate sheet of what you are currently paying and the rate sheet of the change in contributions effective August 1, 2022.

If you vote YES to approve the tentative agreement, changes to the contribution amounts will change effective August 1, 2022. If you vote NO, there will be no change to the contribution amounts, and you will continue to pay the higher rates. Your Unit 15 Negotiating Team is recommending that you vote YES to approve this tentative agreement.

You will only be voting on a TA for the employers’ EUTF contribution which is not subject to final and binding arbitration. The arbitration decision that will resolve the rest of the unit’s first contract, including salaries, is pending, and we will notify employees in a separate eBlast once it is received.

VOTING INSTRUCTIONS:

Ratification voting will be conducted electronically beginning today, Friday, July 22, 2022 through 4:30 PM on Wednesday, July 27, 2022.

Later today, Friday, July 22, 2022, you will receive a ballot in your personal email from “HGEA Ballot” with the subject, “BALLOT: HGEA Unit 15 EUTF Ratification.”

The electronic voting deadline is 4:30 PM on Wednesday, July 27, 2022.

PSD Proposing Changes to Promotions Process for Deputy Sheriffs III through V

HGEA received a letter from the Department of Public Safety seeking to make changes to the promotional process for Deputy Sheriffs III through V within the Sheriff Division.

Here is a summary of the employer’s proposed changes:

The employer will provide broad areas of focus (i.e. Search and Seizure, Laws of Arrest, ICS, Use of Force, Revised Statutes, etc.) which will be included in the internal vacancy announcement to provide deputies with direction in the areas that they will be tested and interviewed
Written test with a passing score of 70% or higher and oral interview scores will be averaged out for ranking purposes
Adopt an order of merit list utilizing the methods of testing and scoring, that will be maintained in-house for one year and used to fill vacancies
Post the order of merit list for all to access

HGEA fully supports career progression, however, we need to ensure that any proposed changes to wages, hours and other terms and conditions of employment are properly negotiated. Proposed changes affecting employee relations are also subject to consultation with HGEA, prior to implementation.

The 26th Biennial HGEA General Assembly will be held September 8-10, 2022 at the Hilton Waikoloa Village on Hawaii Island. As the highest governing body of the union, the General Assembly considers amendments to the HGEA charter of incorporation and bylaws, and other non-charter and bylaws or general resolutions.

The Committee on Charter, Bylaws and Resolutions is responsible for reviewing all proposed resolutions and making a recommendation to the General Assembly. Although the May 11 deadline to submit a charter or bylaws resolution has passed, members may still submit a general or non-charter/bylaws resolution for consideration by the 2022 General Assembly by downloading the packet and using the form relating to general resolutions. Guidelines and instructions on how to prepare and submit a resolution are provided for your reference. The deadline to submit a general or non-charter/bylaws resolution is TODAY at 4:30 PM.

Congrats to Oahu Juvenile Probation Officers!

After a 7-year grievance, six Judiciary Department employees and HGEA members on Oahu were sworn in as State of Hawaii Judiciary Probation Officers within the First Circuit Family Court on May 13, making it a first in Hawaii’s history.

“It’s been a long journey. HGEA really supported us, they went to bat for us, and they advocate for their employees,” said Renee Kuhau, Social Worker and Juvenile Probation Officer of 30 years.

In 2015, Social Worker and Juvenile Probation Officer Whitney Kawata raised safety concerns to his supervisor, Kuhau, about not having the proper tools to do his job effectively and safely. This included a badge and credentials, being appointed, and field training. After several attempts of raising the issue through the proper chain of command, Kawata, with Kuhau’s support, filed a grievance with HGEA and contacted state lawmakers, including Representative Linda Ichiyama. This led to the introduction of S.B. 2836 and H.B. 1733 that prompted the Judiciary to act. The members have yet to receive their badges and credentials, but per administration, it will follow.

“HGEA went through legislation for us. Thank you very much. I’m happy HGEA and legislators, and Representative Linda Ichiyama, saw the issue and backed it up,” said Kawata.

“From the beginning, HGEA’s care and concern to really hear our voice was taken seriously, and for that, we are eternally grateful,” said Kuhau. She continued, “I am extremely grateful for everyone who surrounded us with support, especially Representative Linda Ichiyama, she heard us and provided that care and support.”
